RELEASE OF LIABILITY AGREEMENT

I understand and am aware that purchasing & riding an electric or gas scooter/bicycle is a HAZARDOUS activity and involves the risk of injury to any and all parts of my body. Despite the risks, I HEREBY AGREE TO FREELY AND EXPRESSLY ASSUME and accept any and ALL RISK of injury or death to the user of the scooter/bicycle.

To the fullest extent allowed by law, I AGREE TO RELEASE SVC, its agents, web site, officers, employees, partners, successors and assigns, the manufacturer, importer and distributor of the equipment FROM ANY AND ALL LIABILITY and responsibility for injuries or damages to the user of this scooter/bicycle or any other person. Also, I AGREE TO RELEASE, HOLD HARMLESS AND INDEMNIFY the seller AND ANY RETAIL STORE from any and all liability for injuries or damages, whether it arises from any NEGLIGENCE or other cause regarding the performance or use of the scooter/bicycle.

This document is a legal binding contract which supercedes any other agreements or representations by or between the parties and is intended to provide a comprehensive release of liability, but is not intended to assert any claims or defense which are prohibited by law. I understand and agree that this agreement will be interpreted pursuant to all laws. If any portion of this agreement is deemed unenforceable, the remainder shall be given full force and effect. I understand that this is legally binding on me and my heirs.

I understand that all adult riders should and children are required by Law to wear a bicycle helmet whenever riding a scooter/bicycle.

I understand that this scooter/bicycle is subject to all laws of the road and that many states and localities have additional laws, which may specifically apply to this scooter/bicycle. I understand that the scooter/bicycle comes equipped with reflectors and that while reflectors may increase the visibility of the bicycle, they cannot guarantee the safety and visibility of the rider. Accordingly, I acknowledge that it is my responsible to equip the scooter/bicycle with legally required lights if it is to be ridden at night.

I understand that children should NEVER ride at dusk or night and adults should NEVER ride at dusk or night unless absolutely necessary.

I understand that regular maintenance is required to keep this scooter/bicycle operating property, that failure to properly maintain the scooter/bicycle may make the scooter/bicycle unsafe. Regular maintenance includes frequent inspection of all quick release mechanisms, wheel retention devices, handlebars and brakes.

I understand that there is no expressed or implied warranty to any of the personal transportation devices from the seller.

THIS IS A RELEASE OF LIABILITY. I UNDERSTAND AND AGREE WITH THE TERMS OF THIS ASSUMPTION OF RISK, INDEMNIFICATION AND RELEASE OF LIABILITY.
